1. Agreement to Terms

By accessing and using the Kotodamako website ("the Site") and purchasing our products, including Audio & Headphones, Smart Watches, Gaming Controllers, and Keyboards & Mice, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our Site or services.

2. User Responsibilities & Account

You are responsible for ensuring the accuracy of the information you provide for order fulfillment, such as shipping address and contact details. While Kotodamako does not currently operate a user account system, all purchases are subject to these terms. You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, or impair the Site's functionality.

3. Orders and Purchases

All orders placed through the Site constitute an offer to purchase the selected products. We reserve the right to accept or decline your order for any reason, including product availability, errors in product or pricing information, or issues identified by our fraud prevention protocols. A contract for sale is formed only when we send you an order confirmation email.

4. Refund & Return Policy

Kotodamako is committed to your satisfaction. You may return eligible items within 30 days of delivery for a full refund or exchange, provided the product is unused, in its original packaging, and includes all accessories. Return shipping costs are the responsibility of the customer, unless the return is due to our error or a defective product. Refunds will be processed to the original payment method within 10-14 business days after we receive and inspect the returned item. Digital products, software licenses, or items marked as "final sale" are not eligible for return unless defective. For defective products, please contact us immediately upon discovery.

5. Intellectual Property Protection

All content on the Kotodamako Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of Kotodamako or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. The compilation of all content on this Site is the exclusive property of Kotodamako. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any material from the Site without our express prior written permission.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Kotodamako, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Our total cumulative liability to you for all claims arising from or related to the Site or these Terms shall not exceed the total amount you have paid to Kotodamako in the 12 months preceding the event giving rise to the liability, or one hundred US dollars (USD $100), whichever is greater.

7. Product Information & Modifications

We strive to display product colors, features, specifications, and details as accurately as possible. However, the visual representation on your screen may vary, and we cannot guarantee complete accuracy. We reserve the right to modify or discontinue any product or service without prior notice. We are not liable for any such modifications, price changes, suspensions, or discontinuances.

8. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.
